TERMS OF SERVICE

01 // THE SERVICE

BrainDump.EXE is a personal productivity tool operated by Unidentified Tech, a sole trader based in New Zealand. The Service allows users to capture thoughts, extract tasks using AI, and manage reminders. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue it at any time.

02 // ACCOUNTS

To use BrainDump.EXE you must create an account. You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Ensuring the information you provide is accurate
• Notifying us immediately if you suspect unauthorised access to your account

You must be at least 13 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these terms.

03 // FREE TIER AND PAID PLANS

BrainDump.EXE offers the following tiers:

• Free — 3 AI agent runs per day and 10 Google Calendar pushes per day. No charge
• Pro — Unlimited AI agent runs and calendar pushes. Billed monthly at the rate displayed at checkout. Subscription renews automatically until cancelled
• Lifetime — One-time payment for unlimited access forever, plus the ability to use your own Groq API key. Priced as displayed at checkout

Prices are displayed in USD. Your bank or card provider may apply currency conversion fees. We are not responsible for any conversion costs.

04 // PAYMENTS AND REFUNDS

All payments are processed securely by Stripe. We do not store your card details.

• Pro subscriptions — billed monthly. You may cancel at any time via the customer portal. Access continues until the end of the current billing period. No partial refunds for unused time
• Lifetime — a one-time payment. Due to the nature of digital products, Lifetime purchases are non-refundable except where required by New Zealand consumer law
• Failed payments — if a Pro subscription payment fails, your account will be automatically downgraded to the free tier. Your data is never deleted due to a payment failure

05 // YOUR CONTENT

You retain full ownership of all notes, tasks, and content you create in BrainDump.EXE. By using the Service you grant us a limited licence to store and process your content solely to provide the Service to you.

We do not use your content for advertising, AI training, or any purpose other than operating the Service. You are responsible for ensuring your content does not violate any laws or third-party rights.

06 // ACCEPTABLE USE

You agree not to use BrainDump.EXE to:

• Store or transmit any content that is illegal, harmful, threatening, or abusive
• Attempt to gain unauthorised access to other users' accounts or data
• Reverse engineer, copy, or redistribute any part of the Service
• Use the Service in a way that could damage, overload, or impair it
• Circumvent usage limits or attempt to abuse the free tier
• Use the AI agent to generate harmful, illegal, or misleading content

Violation of these terms may result in immediate account suspension without notice.

07 // AI FEATURES

The AI agent feature is powered by Groq's API using the Llama language model. By using the agent you acknowledge that:

• AI-generated content may not always be accurate or complete
• You are responsible for reviewing and verifying any tasks or suggestions generated by the AI
• Your note content is sent to Groq for processing when you run the agent. Groq does not retain your content after processing
• Lifetime users who provide their own Groq API key are subject to Groq's own terms of service

08 // AVAILABILITY AND UPTIME

We aim to keep BrainDump.EXE available at all times but do not guarantee uninterrupted access. The Service depends on third-party infrastructure including Google Firebase, Cloudflare, and Groq. We are not liable for downtime caused by these providers.

We may perform maintenance that temporarily affects availability. Where possible we will provide advance notice.

09 // LIMITATION OF LIABILITY

To the maximum extent permitted by New Zealand law, Unidentified Tech is not liable for:

• Loss of data due to technical failures (though we take reasonable steps to prevent this)
• Any indirect, incidental, or consequential damages arising from use of the Service
• Actions taken based on AI-generated content
• Service interruptions caused by third-party providers

Our total liability to you for any claim arising from use of the Service is limited to the amount you paid us in the 12 months prior to the claim.

10 // TERMINATION

You may delete your account at any time by contacting us at unidentifiedtechxpert@gmail.com. We will remove your data within 30 days of a deletion request.

We reserve the right to terminate or suspend accounts that violate these terms, with or without notice. Pro subscribers whose accounts are terminated by us for reasons other than terms violations will receive a pro-rated refund.

11 // CHANGES TO THESE TERMS

We may update these Terms of Service from time to time. We will notify users of significant changes via the app or email. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.

12 // GOVERNING LAW

These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts. For consumer disputes, you may also contact the Consumer Protection service.
